POST JUDGEMENT MODIFICATION

 

The need for modifications arises because of a substantial change in circumstances.

In the case of child support modifications, the loss of a job or job gain, resulting in decrease or increase in pay, an increase or decrease in child care expenses, new or increased tuition for private schools or college, new or increased health care needs of the child, a teenager requests to live with other parent, the evolving needs of growing children, and other events can bring about the need to make changes in the amount of child support after a divorce. Spousal support will terminate automatically upon the remarriage of the spouse receiving support, but in situations where the spouse who receives support moves in with someone but does not get remarried, you may still be able to terminate or modify support payments. California law provides that when there is cohabitation by the spouse receiving support, then the support may be modified. However, you must act immediately to get the court to modify, otherwise you will still be obligated to continue paying support to your spouse.
